Terms of service
Terms of Service
1. Overview
This website is operated by Tape Co. Throughout these Terms, “Tape Co”, “we”, “us” and “our” refer to Tape Co.
These Terms of Service govern your access to and use of tapeco.com.au, including purchases made through the website. By using our website or placing an order, you agree to these Terms and our Privacy Policy.
Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded, including rights available under the Australian Consumer Law.
2. Eligibility and account information
You must provide accurate, current and complete information when placing an order or creating an account.
You are responsible for maintaining the security of your account details and for activity conducted through your account. Please notify us promptly if you believe your account has been accessed without permission.
3. Products and product information
We take reasonable care to ensure that product descriptions, specifications, dimensions, images and prices are accurate. However, colours and product appearance may vary slightly depending on your device, screen settings and manufacturing tolerances.
Unless expressly stated otherwise, dimensions and specifications are approximate. Product packaging, branding or appearance may change without notice where this does not materially affect the product.
Adhesive performance can vary depending on the surface, preparation, temperature, application method and intended use. Customers should review the product information and, where appropriate, test the product on a small or inconspicuous area before full application.
Information provided on our website is general product information and is not a substitute for professional or technical advice for a particular application.
Nothing in this section limits any rights you may have under Australian Consumer Law.
4. Orders
Submitting an order is an offer to purchase products from us. An order is accepted when we confirm acceptance or dispatch the products.
We may decline or cancel an order where:
- A product is unavailable
- There is an obvious pricing or product-information error
- Payment cannot be processed
- We reasonably suspect fraud or unauthorised activity
- We cannot deliver to the requested location
- The order breaches these Terms or applicable law
If we cancel an order after receiving payment, we will refund the affected amount to the original payment method.
Please check your order carefully before submitting it. We may be unable to change or cancel an order after it has entered processing, particularly for custom, cut, slit, printed or special-order products.
We accept orders for personal, business, trade and wholesale use. Separate quoted terms may apply to wholesale, custom or account-based orders. Where separately agreed written terms conflict with these Terms, the separately agreed terms will apply to that order.
5. Prices and payment
Unless otherwise stated:
- Website prices are in Australian dollars
- Prices include GST where applicable
- Delivery charges are calculated and displayed at checkout
Wholesale quotations or trade pricing may be shown exclusive of GST where clearly stated.
Prices, promotions and availability may change without notice. The price applicable to an accepted order is the price shown when the order is placed, subject to correction of obvious errors.
You confirm that you are authorised to use the payment method provided and that the payment information is accurate.
6. Promotions and discount codes
Promotions and discount codes may be subject to separate conditions, including expiry dates, minimum-order requirements, product exclusions and limits on use.
Unless otherwise stated, discount codes cannot be combined. We may cancel or refuse a discount where it has been used contrary to its conditions or as a result of an obvious error.
7. Shipping and delivery
Orders are shipped in accordance with our Shipping Policy.
Dispatch and delivery timeframes are estimates unless we expressly agree otherwise. Delivery may be affected by carrier delays, weather, public holidays, remote locations and other circumstances outside our reasonable control.
If an order is delayed, lost or damaged in transit, please contact us at sales@tapeco.com.au so we can investigate and provide an appropriate resolution.
Nothing in this section limits your rights under Australian Consumer Law, including where products are not supplied within an agreed or reasonable time.
8. Returns, refunds and consumer guarantees
Returns, exchanges and refunds are handled in accordance with our Return and Refund Policy and Australian Consumer Law.
Custom-made, custom-printed, specially ordered, cut, slit or otherwise converted products may not be returned for change of mind. This does not affect any rights relating to faulty, damaged, incorrectly supplied or misdescribed products.
Our products come with consumer guarantees that cannot be excluded under Australian Consumer Law.
9. Website use
You must not use the website:
- For an unlawful, fraudulent or malicious purpose
- To interfere with the security or operation of the website
- To introduce viruses, malicious code or harmful technology
- To collect another person’s information without authority
- To impersonate another person or entity
- To infringe intellectual property, privacy or other legal rights
- To send spam or unauthorised promotional material
- To scrape, reproduce or commercially exploit website content without permission
We may restrict or suspend access where we reasonably believe the website is being misused.
10. Intellectual property
Unless otherwise stated, the content of this website—including text, graphics, photographs, product information, logos and website design—is owned by or licensed to Tape Co and is protected by applicable intellectual property laws.
You may view and use the website for lawful personal or business purchasing purposes. You must not reproduce, distribute, modify, republish or commercially exploit our content without prior written permission.
Product names, trademarks and logos belonging to manufacturers or other third parties remain the property of their respective owners.
11. Third-party services and links
Our website may use or link to third-party services, including payment providers, shipping providers and Shopify.
Third-party services are governed by their own terms and privacy policies. We are not responsible for independent third-party websites or services, except to the extent required by law.
Tape Co’s online store is powered by Shopify. Purchases from this store are made directly from Tape Co, not Shopify.
12. Privacy
We handle personal information in accordance with our Privacy Policy.
Our website is hosted by Shopify, which processes certain information to provide ecommerce and related services. Other service providers may process information where reasonably required for payments, delivery, analytics, fraud prevention and website operation.
13. Reviews and feedback
If you provide a product review, photograph, suggestion or other feedback, you confirm that:
- You have the right to provide it
- It is accurate and not misleading
- It does not infringe another person’s rights
- It does not contain unlawful, abusive or harmful content
You grant Tape Co a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that feedback for operating and promoting our business. We may moderate or remove content that breaches these Terms.
14. Errors and website availability
We may correct errors or omissions in product descriptions, pricing, promotions, availability, shipping information or other website content.
We do not guarantee that the website will always be uninterrupted or error-free. We may suspend or change parts of the website for maintenance, security or operational reasons.
If an error affects an order, we will contact you and provide an appropriate resolution, which may include giving you the option to proceed with corrected information or receive a refund.
15. Liability
To the maximum extent permitted by law, Tape Co is not liable for indirect or consequential loss arising from use of the website or products where that loss was not reasonably foreseeable.
Where a guarantee, condition or warranty is implied by law and cannot be excluded, our liability will be determined in accordance with that law.
Nothing in these Terms excludes, restricts or modifies rights, guarantees, remedies or liabilities that cannot lawfully be excluded, including those under Australian Consumer Law.
16. Indemnity
To the extent permitted by law, you are responsible for loss suffered by Tape Co as a direct result of your unlawful use of the website, infringement of another person’s rights or material breach of these Terms.
This section does not require you to indemnify Tape Co for loss caused by our negligence, unlawful conduct or breach of these Terms.
17. Severability and waiver
If any provision of these Terms is found to be invalid or unenforceable, it will be severed or limited to the minimum extent necessary. The remaining provisions will continue to apply.
A failure or delay in enforcing a right does not waive that right.
18. Governing law
These Terms are governed by the laws of Queensland, Australia. The parties submit to the jurisdiction of the courts of Queensland and any courts entitled to hear appeals from them.
This does not prevent a customer from exercising any rights available under applicable consumer law.
19. Changes to these Terms
We may update these Terms from time to time by publishing the revised version on our website.
Changes will apply from the date they are published and will not retrospectively alter an order already accepted, unless required by law or agreed with you.
